Manafort was seen arriving at the US District Court for the District of Columbia on Wednesday morning for his scheduled appearance before Judge Amy Berman Jackson.
"We just have to sit and wait for each time the special counsel's office exceeds its jurisdiction", Downing said, describing how Manafort should also be able to sue before he faces more criminal charges. Mueller's team in a filing on Monday rebutted Manafort and asked the court to dismiss his lawsuit, saying it "lacks merit".
In the filing, the special counsel's office argues that a federal judge should not throw out Manafort's case.
Without an order from the court stopping Mueller's office from pursuing other charges in the future - based on an appointment order that Downing contends was unlawful - Manafort would have to "sit and wait" and keep chasing the special counsel's office wherever they made a decision to prosecute him next in order to challenge Mueller's appointment, Downing said.
